App Terms of Service

The Conservative Party operates the CPC mobile app (denoted as “the app”, and “CPC app”). By using or downloading the app, the user accepts these Terms of Service (denoted as “the agreement”). If the user does not agree to all terms and conditions of this document, they should not use the app.

  1. Who may use the Service

Users must be at least 14 years of age to use the app. Use of the app contrary to this term will void the agreement. By using the app, the user represents and warrants that they are within the capacity of entering this agreement and to abide by the terms and conditions.

 

  1. License to Use the App

Except as expressly authorized in writing by The Conservative Party, the user may not reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble the CPC mobile app. Nor shall any measure be taken to interfere with or damage the app. Unless otherwise indicated all associated logos, designs, texts, graphics, pictures, data, software, and other files associated with the app are the property of the Conservative Party. All rights not expressly granted by the Conservative Party are reserved.

 

  1. Registration

Users must register an account with the CPC app. If Facebook or Google login is used to register an account, users are authorized to access certain information in their relevant account. By accessing one’s Facebook account, users expressly acknowledge and agree that the Conservative Party may obtain their name and profile pictures.

The user is responsible for all activities conducted through their own personal account, regardless of who conducts these activities. Users are responsible for maintaining confidentiality of account information, including username and passwords. Users agree to immediately notify the Conservative Party at [email protected] of any unauthorized account use or any other breach of security. The Conservative party is not responsible or liable for any loss or damage resulting from failure by the user to protect username or password.

 

  1. Privacy

The user’s privacy rights are set forth in the CPC App Privacy Policy (denoted as “the Privacy Policy), which will be considered part of this agreement.

 

  1. Licenses Granted by the User

The user grants all users of the app permission to view any content that the user makes public or otherwise shares. The user also agrees that the Conservative Party shall hold a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license and right to copy, transmit, distribute, and display (through all media now known or hereafter created), and make derivative works from any content that is uploaded or transmitted through the app. In addition, the user shall waive any so-called “moral rights” in your Content.

 

  1. Code of Conduct and Prohibited Activities

In using the app, the user agrees to behave and communicate in a civil and respectful manner at all times in adherence to the rules, found here. The CPC Privacy Policy will be considered part of this agreement.

The Conservative Party does not have any obligation to prescreen, monitor, edit, or remove any user content posted with the CPC app.

However, the Conservative Party retains the right, for any reason, to prescreen, monitor, edit, remove, or move user content posted on the app. The Conservative Party is not responsible for any user content posted using the CPC app.

The Conservative Party has no obligation to retain or provide the user with copies of content, nor does the Conservative Party guarantee any confidentiality with respect to user content. The Conservative Party has the right (but not the obligation) to refuse to publish, remove, or block access to any user content, at any time and for any reason, with or without notice.

 

  1. Terms of Termination

The agreement begins on the date that the user first uses the app until terminated according to the provisions of the Terms of Service.

The Conservative Party reserves the right to suspend, disable, or delete the user’s account if the Conservative party determines that the user has violated any provision of the agreement or that user content or user conduct would damage the reputation, public image, or intentions of the Conservative Party. The Conservative Party retains sole discretion over such determination. Users who have had their account deleted by the Conservative Party for any reason may not register again under the same or under a different name.

Upon termination of the agreement, all licenses granted by the Conservative Party will terminate. In the event of account deletion, user content will no longer be available to said user. The Conservative Party shall not be held responsible for any loss of content.

  1. Disclaimers, Limitations, & Liability

Use of the CPC app is provided without warranty and is at the user’s own risk. The Conservative Party disclaims all warranties expressed, implied, statutory, or otherwise including but not limited to any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Conservative Party does not make any warranty or representation respecting the completeness, security, reliability, quality, accuracy, or availability of the app or it’s services, correction of defects, that content or servers associated with the app are free of viruses or harmful software, or that the app will otherwise meet all needs and expectations. The Conservative Party is not liable for any loss or damage that may arise from the app or usage thereof.

If the user is dissatisfied with the app, the sole and exclusive right and remedy of the user is to terminate the relevant account and discontinue use of the app.

The Conservative Party is not responsible for interactions any user may experience with other users. The Conservative Party does not attempt to verify the truth or accuracy of statements or content made by users of the app, nor does the Conservative Party make any representations of warranties relating to the conduct of users or compatibility with any current or future user.

The Conservative Party shall not be held liable for any damages whatsoever whether direct, indirect, general, special, exemplary, compensatory, consequential, or accidental, resulting from or relating to the conduct of the user or anyone else in connection with the CPC app including, but not limited to, bodily injury, death, emotional distress, or any other damages resulting from communications or meeting with other users of the app or persons met in association with the app. The user agrees to take reasonable precautions in all interactions with other persons and users particularly if they chose to meet offline or in person.

The Conservative Party reserves the right to modify, suspend, or terminate the app at any time. The Conservative party has no obligation to screen or monitor any content on or available through the CPC app and does not guarantee that any content available will comply with the agreement or will be suitable for all users.

All applicable express, implied, and statutory warranties considered valid under the agreement will be limited in duration to a period of thirty (30) days after the date on which the user first used the CPC app, and no warranties shall apply after such a period.

To the extent permitted by law, the Conservative Party will not be liable in any event for any indirect, incidental, consequential, special, punitive, or exemplary damages resulting from or related to the use of or inability to use the CPC app, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable. The Conservative Party’s Maximum aggregate liability to any user for losses or damages suffered in connection with the terms of use or the app or any content is limited to CAD $100.00.

 

  1. Content restrictions

Any and all users are responsible for their own content that they publish or display ( denoted alternately as “post”) through or on the app or transmit to other users. The user agrees that everything posted will comply with the CPC Code of Conduct.

Use of the app, including but not limited to the content posted, must be in accordance with any and all applicable laws and regulations.

Any personally identifiable information provided by the user either in their public profile or elsewhere on any public area of the app, such as telephone numbers, street addresses, last names, URLs, email addresses, or other information, is done at the sole risk of the user. The user shall acknowledge this risk and agree that the Conservative Party shall have no liability or obligation with respect to any third-party use of such identifiable information.

 

  1. User Representation and Warranties

For any and all Content that the user submits, said user shall represent and warrant that: (i) the user has the right to submit the content to the Service and grant the licenses set forth above; (ii) the Conservative Party will not need to obtain licenses from any third party or pay royalties to any third party; (iii) any user content does not infringe any third party’s rights, including intellectual property rights and privacy rights; (iv) user content shall comply with this Agreement and all applicable laws; and (v) the user will adhere to the CPC Code of Conduct.

 

  1. Indemnification

The user shall indemnify, defend, and hold harmless the Conservative Party and its affiliates, directors, officers, employees, and agents, from and against all third party actions that: (i) arise from user’s usage of and activities on the app; (ii) assert a violation by the user of any term of this Agreement; or (iii) assert that any content submitted to the app violates any law or infringes any third party rights, including any intellectual property or privacy right.

  1. Third Party Copyrights and Other Copyright Policy

The user is responsible for ensuring that the materials they upload to the Service do not infringe any third party copyright.

The Conservative Party will promptly remove materials in accordance with the Notice and Notice regime as stated in Canada’s Copyright Act, if properly notified that the materials infringe a third party’s copyright. In addition, The Conservative Party may, in appropriate circumstances, terminate the accounts of repeat copyright infringers.
